Hearing on Umno land transfer set for June 24

THE Kuala Lumpur High Court yesterday set June 24 to hear the originating summons filed by UMNO seeking an order for the transfer of ownership of a 9,723-square-metre parcel of land in the capital to the party.

Lawyer Nor Hazira Abu Haiyan, representing UMNO, said the date was set during the case management before Senior Assistant Registrar Nur Shasha Hidayah Nor Azahar via e-Review on Wednesday.

The originating summons was filed by UMNO Executive Secretary Datuk Mohd Sumali Reduan on March 6, naming the Registrar of the Federal Territory Land and Mines Office as the defendant.

In the suit, UMNO is seeking an order that the ownership of grant 78154, Lot 40 Section 51, Kuala Lumpur, registered in the names of the trustees, namely the late Daim Zainuddin, Musa Hitam, Dr Mahathir Mohamad and the late Sanusi Junid, be transferred to UMNO by Clause 27.1 of the party constitution and Section 9 of the Societies Act 1966.

Apart from that,  UMNO is seeking an order to compel the Registrar of Titles or the Federal Territory Land Administrator to implement the order by making a memorial in the land title documents.

Based on a supporting affidavit, Mohd Sumali said that based on Schedule Form 17, the application for permission to transfer the land ownership, dated Oct 27, 2015, for the property, which was accompanied by a Letter of Declaration dated Oct 22, 2015,  was confirmed and signed by the four leaders involved.

He said the  UMNO office bearers, consisting of the party President, Deputy President and Secretary-General, have agreed through a Letter of Declaration dated Dec 10, 2015, to re-register the property from the previous trustees to the party.

He said that through a letter dated 28 Dec 2015 from the Office of the Director of Land and Mines of the Federal Territory, the Kuala Lumpur Federal Territory Land Works Committee had approved the transfer of ownership from the Trustees to UMNO.

“However, when the process for transfer of ownership via Form 14A dated April 25, 2016, was carried out and submitted by the plaintiff’s lawyer (UMNO) to the Kuala Lumpur Federal Territory Land and Mines Office (PTGKL), the Form 14A application was rejected on May 18, 2017, on the grounds that the names stated on the land title did not match the names on the identity cards,” he said in the affidavit.”

 

 

 

Saman pemula tuntutan harta bermula 24 Jun

MAHKAMAH Tinggi Kuala Lumpur menetapkan 24 Jun ini untuk mendengar saman pemula difailkan UMNO bagi mendapatkan pengisytiharan supaya sebidang tanah di ibu kota berkeluasan 9,723 meter persegi dipindah milik kepada parti politik berkenaan.

Peguam Nor Hazira Abu Haiyan yang mewakili UMNO, berkata tarikh itu ditetapkan semasa pengurusan kes di hadapan Penolong Kanan Pendaftar Nur Shasha Hidayah Nor Azahar secara e-Review semalam.

Saman itu yang difailkan oleh Setiausaha Kerja UMNO, Datuk Mohd Sumali Reduan pada 6 Mac lalu, menamakan Pendaftar Pejabat Tanah dan Galian Wilayah Persekutuan sebagai defendan.

Menerusi saman itu, UMNO memohon perintah bahawa pemilikan geran 78154, Lot 40 Seksyen 51, Bandar Kuala Lumpur yang didaftar atas nama pemegang-pemegang amanah iaitu Allahyarham Tun Daim Zainuddin, Tun Musa Hitam, Tun Dr Mahathir Mohamad dan Allahyarham Tan Sri Sanusi Junid dipindahkan kepada UMNO mengikut Fasal 27.1 Perlembagaan Pertubuhan Kebangsaan Melayu Bersatu dan Seksyen 9 Akta Pertubuhan 1966.

Selain itu, UMNO memohon Pendaftar Hakmilik Wilayah Persekutuan atau Pentadbir Tanah Wilayah Persekutuan melaksanakan perintah tersebut dengan membuat memorial di dalam dokumen hak milik.

Afidavit sokongan Mohd Sumali menyebut berdasarkan Borang Jadual 17, permohonan kebenaran untuk pindah milik tanah bertarikh 27 Oktober 2015 bagi hartanah itu yang disertakan dengan Surat Akuan bertarikh 22 Oktober 2015 telah disahkan serta ditandatangani oleh empat pemimpin terbabit.

“Dua pemegang amanah telah meninggal dunia iaitu Sanusi pada 9 Mac 2018 dan Daim pada 13 November 2024. Kematian Daim telah diketahui umum berikutan penyebaran berita tersebut di pelbagai platform sama ada luar talian mahupun dalam talian termasuk media sosial, portal berita, surat khabar, radio dan televisyen,” kata Hazira.

Mohd Sumali berkata pemegang jawatan UMNO yang terdiri daripada Presiden, Timbalan Presiden dan Setiausaha Agung telah bersetuju melalui Surat Akuan bertarikh 10 Disember 2015 untuk mendaftar semula hartanah tersebut daripada pemegang-pemegang amanah terdahulu kepada parti itu.

Beliau berkata melalui surat bertarikh 28 Disember 2015 daripada Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan, Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur telah meluluskan untuk kebenaran pindah milik daripada Pemegang-pemegang Amanah tersebut kepada UMNO.

“Bagaimanapun, ketika proses untuk pindah milik melalui Borang 14A bertarikh 25 April 2016 dilakukan dan diserahkan oleh peguam plaintif kepada Pejabat Tanah dan Galian Wilayah Persekutuan Kuala Lumpur, permohonan Borang 14A tersebut telah ditolak pada 18 Mei 2017 atas alasan nama seperti di dalam geran hartanah adalah tidak sama seperti dalam kad pengenalan,” katanya.
